The Dangers of Lead Paint are well established, lead causes long term damage to both children and adults.   

Lead paint was banned nationally in 1978 and is estimated that 80% of the housing stock in South Jersey was built before 1970 making lead paint being present highly likely, meaning layers of lead-based paint are likely to still exist in older buildings.

Lead was used in paint, stains and varnishes as it hastened drying time, helped resist moisture and made the coating more durable, everything you want in a coating. In 1992, legislation required the EPA and HUD to disclose any information about lead-based paint in homes going up for sale or lease, this was called Title X. This was the disclosure statement that sellers signed.



New Jersey has taken an aggressive stance on Lead and has passed what is called the NJ Lead Safe Law, which requires landlords to complete lead paint risk assessments on most all rental properties built before 1978.

Effective July 22, 2022, New Jersey requires lead paint inspection for all targeted rental units, or by July 24, 2024, if there is no tenant turnover. This new law is not currently tied to time-of-sale requirements. The Lead-Safe Certification will be valid for a two-year period.


If you rent pre-1978 property that does not qualify for one of the exemptions, beginning July 2022, you will be required to have a Visual Lead-Paint Inspection.  Not only that, but also possibly obtain lead dust wipe samples upon turnover of every unit or every three years and obtain a Lead Safe Certification, (which is only good for two years).
